All participants and students (hereinafter: the “Participant”) must agree to this form before participating in any live training classes or related activities with Arc Movement Studio Inc. (hereinafter: “the Company”). If the Participant is under 18 years of age, a parent or guardian must also agree to this form.
Please understand admission to live training classes or related activities will not be granted if this form is not agreed upon prior to class.
This Agreement is between the Company and the Participant.
1. The Participant recognizes and understands that fitness training requires physical exertion, which may be strenuous and may cause physical injury. The Participant fully understands the risks of physical injury inherent to fitness training and related activities and fully assumes those risks involved.
2. The Participant represents and warrants that they are in good physical condition and have no medical condition and or/allergies that would prevent and/ or limit their full participation in the fitness program. The Participant understands that it is their responsibility to consult with a physician prior to, and in regards to, their participation in the fitness program with the Company.
3. The Participant, hereby certifies that they have not been advised against participating in fitness training or related activities, such as, but not limited to, the fitness program with the Company, by a qualified health professional.
4. In consideration of being permitted to participate in the fitness program with the Company, the Participant agrees to assume full responsibility for any risks, injuries and/or damages, known or unknown, now or in the future, which they might incur as a result of participation in the fitness program with the Company.
5. The Participant is aware that this is a release of liability and knowingly, voluntarily and expressly waives any claim they may have against the Company for injury or damages that they may sustain as a result of participation in the fitness program with the Company or in connection with any instruction from the Company and its employees and/or contractors, inclusive of, fitness instructors and staff members, while the Participant is enrolled in the program.
6. The Participant further understands they are waiving certain legal rights and agree to be forever prevented from suing or otherwise claiming against the Company and its providers for any personal injury that they may sustain during their participation in the fitness program with the Company.
7. The Participant recognizes that recordings of the fitness program with the Company are strictly prohibited. The Participant is aware that if the recording is shared with them during or after completion of the fitness program with the Company, it is for educational purposes exclusively, and not to be shared, sold or otherwise distributed. The Participant agrees to not reproduce, sell, share or distribute any recordings of the fitness program with the Company.
8. The Participant understands that music used in any video recording and/or session is not the property of the Company and is for educational purposes only. The Participant is further aware that by signing up or participating in the fitness program with the Company that it does not grant the Participant a license or permission to use third party copyright materials including music.
9. This Agreement will be governed and construed in accordance with the law of B.C.
The Participant has read, understands, and fully agrees to the terms of this Agreement. Checking the box upon booking is proof of the Participant’s intentions to execute a completed and unconditional Waiver and release of all liability to the full extent of the law.
Prior to booking, please read our studio policy below. All bookings are deemed to be an acknowledgment and acceptance of this policy.
Arc Studio has a 24-hour cancellation policy. In the event of cancellation, notice must be given via email to email@example.com or phone call to (604)423-9974 with a minimum of 24 hours notice.
Please note that failure to notify the studio of cancellation 24 hours in advance will result in full charges for the session.
Expiry dates for the respective packages are as follows, beginning from the first day of purchase:
4 session package: 2 months from date of purchase
8 session package: 3 months from date of purchase
12 session package: 4 months from date of purchase
All packages are non-refundable and non-transferable. In circumstances such as extended illness or vacation, notice must be given in advance for the package to be put on hold.
